Dealing with copycats is unfortunately unavoidable when publishing anything online. The good news is that it is not difficult to get copied logos removed.

Your first step should be a friendly email to the person using the logo. Here is the template we use:

-------
"Your use of the logo listed below infringes on the rights of the copyright holder. While we are delighted that you would like to use this logo on your web site, we do require that you either purchase the rights to the original logo through the LogoGround link below or that you delete it from your web site. Whichever you choose, we would appreciate your response within the next two business days in order to avoid further action."
-------

Include links to the original logo on LogoGround and to the copied logo.

If you receive no response and if the copied logo appears on a platform like Facebook/Twitter etc., those sites can be contacted directly. Here are some links:

The last resort is sending a DMCA notice to their hosting company. To determine the hosting company use a service like:
http://www.whoishostingthis.com/
You can also do a whois search, where the name servers will often indicate who the hosting company is. Then visit the hosting company's web site. Many hosting companies have a dedicated form for DMCA complaints.

For help with DMCA notices, see our help page here which includes an example:
http://www.logoground.com/dmca-take-down-example.php

In our experience the copied logo is removed (or purchased) virtually every time.

Something to keep in mind:
Only the copyright holder or someone authorized by the copyright holder may send a DMCA notice. At LogoGround we transfer the copyright to the client when a sale occurs. You should only send DMCA notices for unsold logos.

I need help on one of my stolen logo

https://www.logoground.com/logo.php?id=158044

I've sent a message to the person who stole it but he never give any replies. I've look through his instagram and found this : https://www.instagram.com/p/CEb1VyzJkUd/
It looks like a patent certificate of his company with a logo that I've created. I don't know much about the law on copyright, could anyone please tell me what does the certificate means?

Thanks in advance

@korzuen

You can still report images on their instagram. Once instagram removes them, they'll contact you by themselves. If they're adequate, they'll purchase the copyright. If not, you can always report their pictures with your logo on their social profiles. They will get tired and try find a compromise.

Was your logo before his (probably: yes)?

If I was you i should contact that institute AND the client of that ‘designer’. Make them clear your design was first and made by you.

Since they tried to make it legal, that company is now presenting ‘stolen goods’.

I suggest that they pay you a reasonable amount of $$$ to buy it and the fact you can’t sell it anymore, because they ruined your business/logo and the damage to your work.

Add also documents, and legal rules about copyrights.

And save the Urls/copies you found.

Offer them a good solution, which is better than loosing their name/reputation or a legal case which costs more than what you ask.

Mention a final date for an update. A few days. Keep it short, do not let them create more time to let work disappear or to remove/redraw the logo.

Good luck, keep us up to date.

@kassymkulov
Yes, I already get the profile picture removed after he did not reply to my message. That is also my go to strategy which seem to works most of the time. They will take my message more seriously after the first image removed by instagram.

@Brandmaistro
My logo was created in 2019, he started using it in 2020.
I'm just having some question about the certificate here: https://www.instagram.com/p/CEb1VyzJkUd/
it seems like it is from Turk Patent which from what I googled is a real government patent office. I don't have much knowledge about it and hope someone can enlighten me.

As for update: I got Instagram to removed his profile picture after he didn't reply to my message that I sent last week (i had mention in the message that he have two working days to reply before I take any action,)

@Korzuen This is their website : http://mardinsigorta.com.tr You can report to their hosting company. You can say that you have original date of upload at LG.

Good find @morabira. However dealing with Turkish hosting provider is hard. Try to report but don't expect quick removal without constant pressure. I see that their hosting provider has live chat, so go through there, it gives you more chance to resolve it than via abuse e-mail. In Turkey they don't have paypal so they can't buy your logo. Thus they don't really care if you are going to remove it or not, they let you try and if you succeed then they go to next one to steal. It is forever process with them and Iranians, frustrating in many ways. What You can offer is to sell logo via western union. I managed to do that twice as a solution, but had to lower the price to 150 USD, because they are cheap, love to negotiate forever and ever and their standard is low.

@korzuen, I found that I can find more thieves when searching from our LG profile page (the thumbnail views without watermark). Just right click the logo and select "Search Google for image".
I just know this google function last week from @eclipse.
Before this I used Yandex from a watermarked logo and rarely found thieves.

This month, I found 7 logos have been stolen when searching from my last and second last profile pages. Working on the reports right now.

Next month will search another pages. Hopefully can find more thieves. Please thieves, steal my logos hehehehhe

@morabira , I used both google image and yandex by uploading the logo without watermark to search for thieves. From my experience, google and yandex yield different result so just to cover all bases better use both.

Update to my Turkey's case: He replied to my message, he is kinda an a-hole and keep telling me that the logo is his then blocked me on instagram. I still keep on reporting while he keep uploading the logo. I don't think the logo is sellable right now since someone is using it. If someone where to buy the logo, should I refuse to sell it? Has anyone have similar experience to this? because I don't think it is fair to sell a logo that been used illegally by someone else. And also I don't want to remove the logo from sale here because I need it as prove that I am the original designer of the logo when submitting report.

We all know that jurisdiction and laws overseas or in another country are more difficult that in one and the same country.
Off course you are right, but keep in mind that you have to start a case about a logo which is $300 - $600. Is't it worth the hassle? My hearts says: Yes! My head says: Mwhaaa?
Of course you are right to dig into it. It's your right. And What Gregory M says is absolutely a good thing to overthink.

But the do not pay you very soon (read: never).
I found an company from Iran. They are into cyber security and network security (but steal your logos anyway, so I say, they are not the right company to secure your stuff).

They f*cked up everything. Then I started to ask socials to delete the avatar first to let them know I was serious. (tip: delete ALL next time). The after weeks they tweaked the logo (same color and 'concept', but is was different. They used it for 3-5 years and told me 'we changed the log, because the first one wasn't good enough'. Sure. But good enough to use it for years.

Changed the logo and new images on their socials contain the 'new' logo. But the older images contain my logo. And older logos are still visible online (at least in Google Images).

So, I have to do the next step.

Original:
https://www.logoground.com/logo.php?id=26426

The stolen logo:
https://www.instagram.com/p/CEHSlDqhlNz/
(still online and they perhaps are still drinking with 'my' logo on their silly mugs)

Their ugly 'new' logo:
https://liangroup.net (top right)
(what a ugly 'thing', if you do a restyling, please, then make it better, do not make it looks like a silly and sad creature).

Talked to them in a nice but clear way. I proposed a $ price with a higher but reasonable price, since my logo is used on 3 websites, socials, roll-up banners, mugs, stationary, etc) and they did this for years. It means my logo is 'unsellable' and the raised price is fairly a cheap and quick solution to settle.

In this case these guys showing the world they are real ***********.
Sneaky asses.

So I have to overthink step two.

I experienced something lately, I would like to share with you.
I asked Youtube a few times to get things deleted from one of their YT users.
Because you can report just a limited number of URLs, I decide to cut it into pieces and reported it in parts.
And I reported them earlier, so it means they got multiple DMCAs.

The copycat asked me if I could cancel the reports, because YT told him they had suspendet his YT channel (hooray!).
That's even beter, because he can't continue his existing channel with a new logo.

It is true that this is a standard protocol, when there are multiple reports about the same YT user? If yes, then it is worth to get it suspended instead of a situation were they only deleted a few logos/images?

Hi Morabira. Good catch. Best thing is that they have 'real stuff' with your logo.
Logo is online (FB) since: 23 september 2019 (!)

I think that having 'real stuff' with a copied logo is a tricky thing and that they can't cover it by a new logo, because of their expensive already paid money.

Good so make screenshots and copy URLs as evidence.
Ask them to pay the (upgraded) price. This one is a good example of 'paying is cheaper that going to court'. And they loose their reputation if you mention them online and give them negative reviews.

@Gregory M , hypothetical question, should a logo designer disclosed that the logo is illegally being used to whoever wanted to buy the logo?

@morabira , it is always a good sign when they have physical product with your logo. High probability they will buy it. Did you at least felt proud to see your logo printed and made into a sign although it was stolen? I know I would haha.

@Brandmaistro . I heard a illustrator spent like thousand of dollars just to pay for a lawyer to send a letter. It is like you said, "My hearts says: Yes! My head says: Mwhaaa?"

Thats a f*cked up story with company from Iran. The audacity to refuse to pay for it after printed it on items and I hate when they tried to wiggle their way out but doing a slight change to the logo and ask "is this okay now?"

I have similar experience with facebook. Rather than reporting the link in bulk, you should report it separately because facebook will suspened their account.

I had a situation where a client bought a logo, then after a day or two asked me about a link where he found logo used by some thief. I said thats a thief and has no rights to the logo and that he should sue because the logo is his property now and not the thieves.

Thats after the logo was already purchased on lg and in the process of being updated with the company name of the buyer.

I submitted reports that are 6 months old over and over but I only get a reply asking for URL and IP Address. After I provide those I either get a reply saying that I can't add url's to report and to submit another one (even though it is same URL as in the report form, submitted to them) or I don't get a reply at all.

I am also experiencing issue with this hosting https://www.lws.fr/

They say that they can't remove content from their website as they are not in position to judge if the content is infringing or not. They only provide space for websites. This is the first time I encounter this, that hosting provider is not in position to decide if the content is infringing or no when the logo is copied 100%, not a single piece is changed, not even colors. But they do have abuse form and a form for copyright infringement notice. I don't know what is the point for copyright infringement notice form, when they can't remove it. Some of these websites are ridiculous.

@kassymkulov my reply to that and it always works is: "I provided copyright document to the relevant companies reviewing DMCA Notice. Why I can't send my copyright document to You? Well, because if I send You the copyright document, I won't be able to stop You from using the logo even though You haven't purchased it. If I report You while You are in a possession of the copyright document, I won't be able to remove the logo, because You would just show the copyright document and my report would be rejected."

Just yesterday I sent this to a person using my logo and they understood it and made an offer on the logo. Now we are kind of negotiating.

Even though this statement is not completely true, it is not up to us to explain it over and over, so I just more or less say that copyright document is a legal document and it can't be sent without the purchase, otherwise I won't be able to stop them from using the logo. That is it.

DESIGNER

Eclipse42,

Maybe you are confusing the government-issued formal registration document (which is what thieves or hosting companies usually ask for as proof) with the copyright transfer document (which is what a designer provides to a client after purchase).

Or, are you are implying that if you send the government-issued formal registration document to a thief, he/she will deceptively alter this document (removing your name and adding their name)? If so, what is stopping them from creating the document from scratch? That is, if they want to doctor a document, they don't need to wait for you to send your document.

If you have a government-issued formal registration document, showing a low-res scan of that document to a third party is not a risk. In any case, forging a government-issue document is a very serious offence. If they engage in this kind of illegal activity, then you will have a more interesting case; you can report them to the government intellectual property office that issued the document in the first place.

Kassymkulov,

When a thief or a hosting company asks for a copyright document, usually they are referring to a copyright registration document, that is, a formal copyright registration document issued by a government intellectual property office.

Under the Berne Convention (which is an international agreement governing copyright), copyright is automatic. Copyright comes into existence as soon as the work is fixed in any medium of expression (e.g., uploading the work to a public website). That is, you do not need formal registration to be protected by international copyright law. Incidentally, the copyright notice with the copyright symbol and year is not mandatory anymore (we still use it, but it is not necessary).

So, no legal document is required and in fact, as per the Berne Convention, it is actually prohibited to require formal registration. Send them the URLs with date stamps from the corresponding servers (of every website you submitted the design to), along with a link to the full text of the Berne Convention, asking them to ask their lawyers to pay close attention to article five:
https://wipolex.wipo.int/en/text/283698

It is noteworthy to mention that about 90% of the countries of the world are Berne Convention signatories.
https://en.wikipedia.org/wiki/Berne_Convention

Hope this helps,

Ortega Graphics

@eclipse42

That's an interesting tactic but unfortunately it doesn't work for me because these thieves are fierce and smart in a bad way. I know that I can transfer copyright formally, it's just that I don't know how I have a copyright formally.

@Ortega Graphics
Thank you. That's exactly what I was looking for. I do remember you mentioning it somewhere but I couldn't find it using forum search. I couldn't understand the Article 5 but I understood that there are 3 basic principle of Berne Convention one of them being automatic protection. And "automatic protection" is the wording I was looking for. Anyone interested can use these:

"Under the principle of automatic protection, a work will be granted protection even if it fails to satisfy formalities, such as registration or legal deposit, under the national law of a member country."

"The works of nationals of all Berne Convention member countries are protected. Some works of authors who are not nationals of Berne Convention member countries may also be protected if the work was first or simultaneously published in a member country."

@Ortega Graphics, thanks for the comment, I learned something new from you again. Regarding my post: The person using my logo usually asks about copyright document, because they have one simple question (well, most of them do) and that question is: "How can I be sure that you are the designer of the logo and how can I be sure that someone else won't contact me saying I am stealing the logo again and asking for another payment" (This is a question from yesterday's thief).

My answer to that is, that he will get a copyright transfer document where it states that I transfer all the rights of the logo to him and that he can use that document to prove he bought the logo and that all the rights belong to him. Again, I am aware that I am simplifying things, because person using the logo is aware he is stealing it, he is just trying to clean his name and pretends that someone sold him the logo. Why I know this ? I know because the lines of the logo are soo poorly executed that it even shows the white outline of their amateur work and exported JPEG or PNG. The tracing is more than obvious and amateurish. But I am being polite to him, so I simplify things in order to describe as short as I can.

After that they ask me to send them the copyright document form Logoground ? Of course I can't do that, because the file is available after the customization is finished, that file is ready for download to them not for me and if I wanted to send the file I would have to create one myself, which is not the same as on Logoground, so I don't want more questions after the purchase and for them to think I changed something or tricked them into buying it. It would just bring too many new questions and I am not willing to go that way or to send them any document from logoground. It is all very clear and when I encounter people using the logo that have a serious business (including lawyers you mentioned), they go through logoground, read everything and buy the logo without any questions. I only deal with this kind of questions from those who are not serious and are trying to get their way out of the illegal use of the logo, claiming someone sold them the logo, even though they never sent me proof of it, no invoice, no e-mail from person that "sold" them the logo, nothing.

For that reason I simplify it again and send the message I previously wrote to kassymkulov about copyright document and why I can't provide it. It always does the trick, after which they either buy the logo and get copyright transfer document that contains all information I said it will. Or they simply offer 50-100 USD, which I reject and we come to an end of conversation. Logo is removed, they will probably steal something else.

I am aware there are differences and I learned from you first about Berne Convention and I use that as explanation to Facebook and Google when they are questioning if I own copyrights on a certain logo. It works like a charm. If the hosting provider is asking me for more evidence I simply provide almost the same sentence you wrote above and I never have any issues.

But for thieves I am not willing to discuss so far, because if someone is serious they won't have any questions, they will simply make a purchase.

From my experience conversion of stolen logo to sales is 5% and almost all of them come with no questions, just a simple purchase and no revisions needed.

Those with lots of questions rarely buy logo. Just now I got e-mail from yesterdays thief with an offer of 100 USD, on a 500 USD logo. Waste of my time. I am glad I did not spend more than 3 minutes writing simple responses.

Guys,

You might be interested in this Chrome extension.
https://chrome.google.com/webstore/detail/search-by-image/cnojnbdhbhnkbcieeekonklommdnndci?hl=en

I found bunch of copied logos used on websites (30+ from my last 3 pages) by using this extension (from profile thumbnail preview and watermarked preview). With this extension, we can use:

1) normal right click search. Or

2) we can set it to use image capture (cropping the image on screen). Here is how to set :
https://photos.app.goo.gl/o1H5XqefQ32iJQBW9
https://photos.app.goo.gl/HJixBkoc3xdW2inA9

To use the second method, right click (Search by Image>All Search Engines). Then draw capture box on our logo, after that click "search".

Use both methods from small thumbnail preview of our profile and also from watermarked logo ...They produce different results.

Thanks Morabira. Happy to see this feature for Chrome. I used a similar extension for Firefox and Safari. When I think or guess a logo is used, then I sometimes try different ways to find a shady business trying to steal your logo. Because the outcome can be a tricky thing. First you think that uploading a medium/large logo with watermarks shows everything. But using a tool like this in combination with a small watermarked logo, then the outcome can be different.

I wish I had a (lawyer) sidekick searching the web every day and start procedures, while I can make cool things in stead of chasing MF's ;-)

For this logo, I chased Turkey website with no luck, then Africa website also with no luck. Lastly, website owner from my country bought it hehehe. He applogized because he unintentionally hired a copycat designer in 2017.

Same here :-)
Safari isn't very piracy-hunting-friendly.
And they also discontinued the PIN IT button extension... ;-(
Which I only use for LG logos.

@Morabira
Sometimes a logo is so popular that a handful of copycats have to fight for owning the rights of the logo ;-)
I experienced the same, start with ass #1, then #2 and then sometimes is has to end with #3.
It becomes hilarious when ass #3 bought the logo and (months after that) you contact them and tell them that ass #1 and #2 also exist and are using 'their' recently bought logo. LOL (best bitchslap moment ever)

@Brandmaistro, when you know their hosting is shopify, you can take as much time as you want to contact them and have a conversation. Reason for a laid back conversation is because you know in advance that, it won't be an issue to remove the content from website, as shopify is fast with it and never cause any issues, so there is no stress in that matter.

Keep it professional and slow and sale is on the way. However you have to take into consideration what they sell. Those are not expensive items, 12-20 dollars, so they might not be able to pay above 250 to 300 USD for a logo. If they can pay more it will be awesome.

DESIGNER
Brandmaistro
2021-01-16

eclipse42

Maybe, but $12 for one pair of socks and $25 for a cap aren’t that bad. Especially when schools order a dozen of it.

And they did an kickstart fundraising and got $1300+
Enough to spend the half of it at an awesome designer... ;-)

$350 is average salary for a normal worker in my country. If a company can pay $350 per month for a worker, I don't think they cannot spend $350 and above for a logo that will be used forever:)
That is why my price is $350 and above. No discount :)

DESIGNER
Brandmaistro

They live in the US. Indeed, I assume the people there don't earn $350 a month. Which is almost nothing.
www.cnbc.com/2017/08/24/how-much-americans-earn-at-every-age.html
$40-50K a year is pretty average IMO. But even if they earn $1K a year, then I don't have to ask them $150 because 'it is for a good cause'.

And since the logo is 'all over the place' (including merchandise, websites, webshops and social media channels), it's market value is also a point to keep in mind. Now they don't pay for the logo, they now ALSO pay for it's market value, the goods they have sold till today and the fact they use it for almost 2 years. Quickly after they started, the first shipment of their merchandise was available on the web. How many $$ did they earned?

For example. Let's say they have or would like to sell at least 1.000 pair of socks x $12 = $12.000 (keep in mind they can sell also other things like caps, tshirts with higher $$$ in the next few years).
Minus the cost of production, then they can still afford a (legally bought) logo between $600-$800.
To be honest, it's not my fault they hired a lousy 'designer'. I don't want to be a part of there team, so I am not the person who pays for their lovely (but stolen) logo.

And if they paid somebody for this, then they must take it back from that person, but that is their problem if they refuse to do that and want to pay twice.

Has anyone every reported something on shopee website in Indonesia.
This is their explanation on how to report, but I have no idea how to do it to be honest. I've read it all and it is still not clear. Their fill out form is even more confusing, it asks for way to many things.

This is their form: https://shopee-support.formstack.com/forms/ipr_my

For example "Nature of informant" is one of the fill outs and given options are IP owner, Brand protection agency and Law firm.

If I choose IP Owner (even though I don't know why would I choose that, but other options are way off) I have to put IP registration number and Local Copyright Registration Certificate.

Basically it seems to me that it is impossible to remove anything from there, but since we have a lot of designers from Indonesia, maybe I can get some information needed for removal, that this website is requiring.

Hi @Eclipse42,

Yes, and it was e hell of a job.
Found a stolen logo and they asked me to fill in a terrible form online, that doesn't work well. Errors and messages which made it impossible to send it.
Contacted them via Facebook and send in a PDF with the filled in field (right from their webform).
Told them about their lousy form, but the asked it multiple times to fill in the web form... -sight-

Finally the did something when I spammed them with my messages.
Finally the logo was deleted.

But that 'Brand protection agency and Law firm' was they same thing that was horrible to understand for them. You don't always have to claim your © by a certificate, lawfirm or any other institute...
They keep asking for that. Like you also experienced today.

Hope you/we don't have to report too much logo by that organization, because it wasn't that easy or funny at all..

They emailed me a form to filled in which was meant for complaint on product, while I was reporting the profile picture that used my logo. I keep emailing them and explain the Berne Convention on copyright things, it took weeks before they remove the logo. Just some inside-info:
That guy earned $1388 with my logo on every image + everything after his business was successful ON-AIR.
But tried to fake the inside knowledge he knows and the fact it was stolen (especially when I told him about the copy). A unknown Fiverr (-sigh- again!!) made that logo for him.
But he refused to tell me the name of the designer and told me that Fiverr/designer told him it was original and they own the copyrights (read: original piece of plagiarism).
Offered him a payment solution, but after a while he refused to answer me...

So he asked me to delete it from LG and rip it out from my entire legacy.
I quess he now thinks that when you buy a logo, that was stolen by himself, he can claim that he is the REAL designer, because he paid for it. Sorry terms and conditions says something else and besides that, he can buy the logo, but as a copycat you can't be so stupid to ask for things in return. Keep that **** logo and STFU.

I'am sure he still want to claim he is the real designer. Especially he have paid to logo.

DESIGNER

Brandmaistro,
Haha, I think they can ask for the logo they bought to be hidden from your sales profile, or maybe removed, but not by claiming the first designer (designed), the buyer remains the buyer along with the copyright in this case the full use rights, but not change the first logo designer.

They may have to learn from Apple which as a designer don't want be forgotten "designed by Apple assembled in China or blablabla". the meaning of the word "designed" is so important that it is attached to the product no matter where it is assembled, still the designing is Apple

By the way, the prices are fantastic, you can settle for eating hot dogs with that money

Yep, deffinitely plagiarism. Its same elephant flipped, same function in the image. essentially he only changed the watter style and didnt use color.

Its not just "idea" being reused, the idea is an halfcircle elephant combined with water. In a circle.
This is thesame damn sideways elephant - halfcircle made from lines minimalistic, ear and eye only detail, 2 legged, 1 trunked elephant. Built from arches.

Maybe accidental because the halfcircle sugests an elephant to be made that way. A different look would be much harder to make but id say you have a case.

In essence the watter part is not important, he copies closely enough a part of your design. You copyright the unique elements of your design as well as a whole. Imagine someone flipped macdonalds M to make it a W and then reflected it in watter... Still plagiarism.

Eclipse42,

The contest holder username includes the word "ventures" and on the contest brief, they mentioned "making the mind as strong as a fortress", as well as requesting a health cross on the design. There is a chance that this is a venture capital firm and maybe they have recently invested on a pharmaceutical startup that has a nootropic product (cognitive enhancer), which would be coherent with their description of "making the mind as strong as a fortress" (think of the "NZT-48" drug from the movie "Limitless"). The logo might not be used as a logo for the venture capital firm, but maybe it will be used as the logo for the pharmaceutical startup or even as the logo for a nootropic product, but the actual name of the product was not specified on the contest brief. If this is the case, then it will be definitely hard to find.

Hope this helps,

Ortega Graphics

Thanks to detailed feedback from all of you!!

I managed to find feedback on designers profile on freelancer.

It seems that person behind Valkyrie Ventures is Jeanette S., so I am going to try to find her somewhere online.

Hi Guys,

Let's flip or rotate the logo before search using this Chrome extension.
https://chrome.google.com/webstore/detail/flip-this/donljlliiecjcagcenoeohjmabfegkph
Right click on a logo, choose "flip this" and do what do you want to do with it (flip horizontal, vertical, rotate etc)
Make sure you don't flip entire page. One logo at a time.

Then search like usual using extension "Search by Image" (Only use Capture Mode)

This is crazy. Your logo became famous all over the world. Most people don't even care to remove the watermark from it. There are at least 10 youtube channels that use it, many Turkish companies and even China!

Yes @morabira, I'm aware if it. Obviously it's not your problem anymore, but as a general issue it is still a huge issue. Right now it can be harmful to the new owner of the logo if he finds out that it has been widely used all over the world.

Here is a thought that came to my mind. If a designer decides to promote his work on Pinterest for example, hoping that it will drive some traffic to the logo and maybe a potential buyer, is he heightening the chances of the design being stolen? I'm myself very reluctant to share any links to my logos on any social platforms. because I'm not sure if this could potentially be way more harmful then helpful, even for future copyright owners of the sold logos...

What are your thoughts on this?

It still can be stolen even though we just leave it on logoground. :) it is our description, title and tags that make the logo can be found by thieves.
The new owner of course uses the logo on public medium such as their website or social media, there the logo can be stolen too.

Plus, when I promote at social media, there will be chances that the potential client reach LG and end up not buying my logo which has been stolen many times, maybe the buyer will buy other designer's fresh logo here. I believe it works like this:

1. They decide to have their own YouTube channel
2. They create Google account
3. They call it "Mister M" for example
4. They are asked to upload a profile picture as their logo
5. They don't have it
6. They quickly google "letter M logo" or "letters MM logo"
7. They find thousands
8. They like for example @morabira's logo because it's nice
9. They upload it as their YouTube channel logo
10. They don't know what a watermark is, hence they don't bother removing it
11. They don't care about having grey lines in the background, they might even think it's part of the design
12. They might not even know what a design is, all they wanted was something for their YT channel
13. They start uploading useless meaningless content to YT
14. They wait for the money to come in from the channel as they want to be rich doing nothing as many others who became millionaires
15. After a year, no money
16. After two years, no money
17. After three years, still no money
18. They abandon the channel and never come back
19. The logo stays there forever
20. Oh, and they didn't "steal" anything. It was just there. Google gave it to them for free. They didn't even click the link to LogoGround to see that this is something for sale. They simply copied the logo from Google photos search results and pasted it somewhere else.

Cloudflare is CDN (Content Delivery Network), not a hosting.
In easy word, the real hosting is hiding behind Cloudflare. To reports these hostings, you need to use this form. At the bottom, tick options for cloudflare to forward the report to hosting and owner.

I ask this about Cloudflare, because yesterday I found this on websites and multiple socials:

https://www.infanta.com.bd (which is a company of Banglamark: https://www.banglamark.com/img/products/it-e-business0301.jpg)

Original: www.logoground.com/logo.php?id=167120

And these three 'designers' seems to be working on this logo and/or customer or are working for Infanta:
https://www.behance.net/nasrinfahm36d7
https://www.behance.net/itronyislam
https://www.behance.net/rafiulislam?tracking_source=search%7CEid-ul%20Azha
https://www.behance.net/gallery/104302801/Himalaya-baby-Product-Facebook-post-For-Infanta-bd

Kind of huge company with multiple companies in the pocket.
So Cloudflare is the biggest obstacle to force them to a agreement/sale.

PS. Normally I report one or more photos when these are found on Facebook. But when they have hundreds of images with the copied logo, then it is madness to report them one by one. If 95% of the images have a stole logo, but the other 5% not. Is it likable that Facebook remove the complete album if you report the album and his content and not the individual images? Or does FB forcing you to report every single image? Does anybody here experienced this?

Well as we speak a sold a logo which was stolen.
Funny (but in some way a sad) detail:

I found two weeks ago a Christian organization that stole this logo: www.logoground.com/logo.php?id=75598 but they were struggling with the funds that were needed to pay me. I reduced the price for them. But It took to long so I told them I changed the price to the original price. And that a sale can also be done by any other company on the planet Earth (and in a few years from Mars).

In the meantime I found another copy of this logo, used by a restaurant in Czech Republic. Within a few hours the logo was sold to this company. So, more money. Quicker sale.

NOTE:
It was a design/web agency that bought that logo. After the sale they send me a short apologize and told me they try to reduce their loss on their former employee, who copied that logo.

Hi @eclipse42
My tactic was to contact them directly (when that was possible).
But the experiment for now is to first freese the content and then contact them directly.
I know, that is sometimes rude.
But I experience to many times the situation that they block me (Instagram is very popular) and/or they delete the logo in minutes.

Well, call it a kidnapping, but they started first with stealing my lovely children (my logos).
When I think it is safe to contact them, then it is okay, but when I am in doubt I prefer the kidnap-method.

Very handy when it comes to saving time. You can add Logoground, Scalebranding and even Pinterest to not appear in the search so that the results shown are only copycats.
There are of course manual ways you can block a website from appearing in the search, but it's just too tech-y, at least for me. So these kind of extensions really help.

The more logos you have here, the better chance for them to be stolen. Some logos uploaded here are already being used somewhere may it be an end-client, contest proposal, stock etc. They will be spotted but not immediately. Yes, we cannot avoid the risk of design theft from irresponsible parties.

It is unfortunate.

Especially the platinum designers here, I see their logo design very valuable, it is very risky to be copied / stolen.

@itDiffers
Sometimes you need to upload different images and sizes, with or without watermarks. Different images give different results. Cropped/trimmed images with only a logo (without text/brandname) will work also. Yes, indeed. That's time consuming. Yandex and Google works best for this. Yandex has a smart 'crop' function to crop a specific area in the uploaded image. So you can quickly see the results. And strange enough results are different when the logo is uploaded in 'standard' condition. Just play with it and see what happens.

the funny thing is, when on the contest site a lot of things like this happen, but the staff still passes and even chooses that candidate, why? obviously it's imitating, is it because their account level or their behavior has an effect on the contest? and it amused me to see him, haaaaa

@areksadesign @Crossthelime I know designers are responsible for their respective designs, but, especially in this case, many designers who become victims are not aware that their designs are stolen and besides that almost all the designs that the suspect stole came from LG. so maybe it would be good for LG to help clarify the matter to the SS so that the problem is resolved faster, rather than having to wait for all the victims to report.

My logo has also been stolen, as I said in the previous discussion.

I have tried to contact shutterstock contact support but there is no further information.

I am worried that if the shutterstock, is slow in dealing with things like this, it will have a huge impact on the logos that are in the loground.

You can imagine if the design thieves, plagiarized the best logos on the loground and then sold them cheaply on Shutterstock, it would be very beneficial for them as sellers and clients would be able to buy a good logo at a low price which turned out to be a stolen logo.

I am sympathetic, not because my logo was stolen, but I am sympathetic to my colleagues who are on this logoground & website.

I can't do much, apart from helping out if there is a design theft and providing information.

@isengine it's ok to upload our design to other platforms, whether it's just a portfolio or even for sale, the important thing is that the design is original and makes it ourself. and if it sells on other platforms then the design must be removed, for example sold at LG then the design at SB must be removed.

And if you meet a case that you believe is a design theft, then you must report it immediately.

Lots of designers (not you guys here ofcourse, he2) thought that it's permissible to mimic those characters likeness that make people can directly connect it to a saiyan Dragon Ball hero for instance...

"Something to keep in mind:
Only the copyright holder or someone authorized by the copyright holder may send a DMCA complaint. At LogoGround we transfer the copyright to the client when a sale occurs. You should only send DMCA notices for unsold logos."

ADMIN
ajleroux
2021-04-19

Macry & CrossTheLime,

We transfer copyright to the client, and a DMCA usually includes a statement saying that you are the copyright holder or that you are an authorized representative of the copyright holder. This would be untrue for our sold logos. You should not send a DMCA notice for a sold logo unless the client authorizes you to do so. Keep in mind that a DMCA notice initiates a legal process, so you want to make very sure that every bit of it is accurate.

ADMIN
ajleroux
2021-04-19

About contacting the client: You can, but it is not necessary. Rob Janoff (designer of the Apple logo) probably doesn't contact Apple when someone uses the Apple logo without permission. :) The designer can't know who does and who does not have permission to use the logo - and the more successful the company the harder the policing becomes. In my experience it is best to leave the protection of the copyright in the client's hands.

Hi all. I have a weird issue. A hosting provider does not want to remove the stolen logo because I have not provided enough evidence. That evidence was my url of original work with date of creation as always. Their response was that it is not good enough and that I have to give them the evidence of upload date of the image on thief's website in order to remove the logo. Now, how can I find the upload date of their image, on their website?

I wrote to them that they can easily access such information, they say it is not their job to do that, it is mine to provide evidence. Ridiculous.

If anybody knows how to find an upload date of an image on their website, I'd be thankful.

DESIGNER

Interesting. The hosting provider definitely knows but they're just lazy and want you to figure it out by yourself.
There are ways to see it using developer tools of a browser (inspect page), but I do not understand it, maybe ask a fellow programmer?
Alternatively you can use wayback machine to show how a website looked at a certain time when they were not using the image.

@eclipse42

If that page is old enough AND indexed by the WatBack machine : https://archive.org, perhaps you can see (or at least observe as close as possible) the date. This platform creates 'snapshots' and backups of websites/p[ages. But not everything can be found there. this is also a trick to proof the existence of logos which were present on the stocklogo.com website. Sometimes you just lucky to find it there.

Eclipse42,

The hosting company is wrong; you do not need to provide them with proof (which they already have). This must be their illegal way to try to get rid of DMCA reports without any action on their part. In any case, there are many ways to check a server's date stamp and most of these ways are only local and private to the owner of said server (not public), but in some cases there are ways to get public information. Since this varies per website, maybe you want to share the details to see if we can find something.

Hope this helps,

Ortega Graphics

Even if they removed a image with your logo, they can ask for more details of you should convince them why this (or even another similar image with your logo) should be removed.

Reporting a photo album with 300+ images with my logo on it (for example) took me weeks until they completely removed it. I reported 20+ images in a report and after this was done I asked them to remove the other 280+ images like they did in the first run.
It's insane to copy/paste and report hundreds of logos... I'm not a machine or a robot.

Thought it was clear that when you report 20+ images and you refer to that, asking to remove also the other images it was easy. But I may have estimated them more intelligently...

Asked them multiple times to removed the left-overs.
I think they do this because they are completely numb.
And I agree that their job is soo boring, that it affect their brains.

Just ask them again to review it.
Sorry mate, it is what it is.

The people there seem very obtuse, i mean this is blatant and they act as if since its a 3d mockup and has minor changes its suddenly different design. These are the kind of people who copy 90% of a paper, paraphrase 10% of the wording, change type and call it their essay. I sent them a visual aid but at this point im feeling they just enjoy wasting as much of my time as they can.

I sent them this:

Its a little eyerapey but you know... i dont want to polish something i shouldnt have to make in the first place...

I had similar issue before, just be persistent (stubborn) and eventually they will remove it. If they close the case, open a new one.

There is a logo design site that uses designs from dribble and Logoground and they just add borders and some decorations, in a way that google does not recognize it as the same image, Facebook support always needs some time to understand. But eventually they do remove it.

Oh dear. I thought I made complete pieces of art (by placing the logo in transparant mode over the original), but this is net next next level.

I wouldn't have made it so difficult.
It's not worth it.
Even a blind human can see the similarities.
It's clear this is just a 99% similar copy.
There is nothing to argue.

I would say: Seen it. Deleted the copy. Case closed.

Ho guys and girls.
I've got an interesting story for you...
Don't know if I should laugh or cry (in the end the result is all the same) ;-)

I found a copy of my SB monogram logo in Thailand.
https://www.logoground.com/logo.php?id=134990

Then I found this:
https://tinyurl.com/pt4926mz

You must be blind if you not see the similarity of the letter monogram.
It's completely the same as you can see here: https://imgur.com/LArdXCG
Monogram is pixelated and flower is razorsharp (also not unique), that's somewhat strange.
It's used on practically everything (window signing, clothing, advertisements, websites, socials, even as a sponsored logo on soccer tshirts).

I confronted the owner and he was quite rude.
Send him evidence, told him he had the opportunity to buy it, because used without permission, datestamps and publication date... etc etc, you know the story about copyrights, intellectual property and so on.

Now the following conversation took place (promise me not to laught):

------
1st replied EMAIL:
Subject: 'Good Luck with That'
Message: 'Go FUCK YOURSELF TROLL'
------
2nd replied EMAIL:
Message: 'There is no similarity of our logo to yours so good luck in your pursuit, our lawyers will have a good time with you. Ours is Totally different from your image sure you can try but the claim you think you have is bogus.
Goodluck in your pursuit of a claim. We will also counter your suit for liable and damages under the computer crimes act here in Thailand. MOST IMPORTANTLY OUR IMAGE/LOGO IS TOTALLY DIFFRENT FROM WHAT YOU CLAIM YOU HAVE RIGHTS TO. You cannot claim over similarities or what you THINK is a likeness.

: Logos are not copyrighted; they are actually trademarked. Whether or not legal action is taken for replicating a trademarked logo is fully up to the company or entity that owns the trademark. A company still has legal rights to their logo even if it's not trademarked.
No further communication is needed. Our legal Staff can deal with you now BYE Troll.'
------

Perhaps things are different in Thailand with regard to copyrights. But a copy is a copy I think. Even if you decorate it with fancy flowers and golden wreaths around it.
I think this real estate guy is not used to any contradiction when he or his 'designer' is wrong. Shouting and name-calling is, in my opinion, a sign of loss of control. Furthermore, he has no substantive arguments other than shouting loudly that it doesn't look like his 'logo' and threatening that his lawyers will eat me alive (or something like that).
Arguing further with this person has no chance. It is too deep in his emotion and is not open to reason, I think.
Sad to see how people turn it around and call me a 'troll' and threaten to destroy me if I only dare to take action.

PS:
Found the pink lotus flower in his logo and it is just an ordinary 'free PNG clipart image' LOL:
https://tinyurl.com/4krv7rh7
And when you use two existing images/logos, why would you put any effort in drawing those golden wings by yourself? Guess these are also clipart, but they are hard to find (when cut out from the rest).

The footer of that website tells me it is hosted by godaddy... so i guess it’s bot that hard to handed over to them and ask for a suspending mode. And the socials are pretty quick and helpful when the similarity is that close. So i think it’s a matter of time until it’s blocked/deleted :-)
The question is: Not IF, but WHEN :-)

@Brandmaistro On the photo You gave us there is too much going on. In case Facebook does not remove it because it is not similar enough, send a second report saying that You are reporting the logo in the middle of the photo. I had numerous times where Facebook did not remove the image because there are too many elements on the photo, they do not want to even look at it and search where is the infringing content (even though it is clearly visible). When I figured out what they want in a report (logo in the middle, logo in upper left corner explanation for example) I reported thieves from previous unremoved reports and got them to remove it at the end.

With youtube non-video removals (avatar, profile image) I am experiencing a strange thing, it is taking them 3-4 months to review them... By the time they're sending me the result, I already do not remember who and why I reported them.
And the answer is always: "It seems the content you reported has been removed by the uploader."
Duh! Because in 3-4 months they've changed their avatar couple of times.

already does not support youtube profile image, they're saying (under the table):
"Note: Google hosts the profile pictures that appear on YouTube channels. For this content, you need to use Google’s webform to submit your removal request."

And the webform is clickable, but when you click it it takes you to counter-notification and not to removing stuff:

What is your experience when it comes to a successful sale as a result of a stolen logo?

Have material removed first and sites suspended through a DMCA claim and then point to a purchase and then a release of reported material?

Or

Contact them first, point out a violation and enforce a purchase as a result, then file DMCA claims (if no satisfactory outcome is achieved). (But at the risk of having it removed before a DMCA claim has been filed).

What is your experience with this?

DMCA first - sale. That's how it's been for me :)
Otherwise they'll think you're a con artist, spammer you name it.
Removal serves as a proof. You don't have to remove everything, just delete a couple of images, wait a day or two, if nothing happens, nuke 'em.

Frankie Soo,

Yes, definitely; I bet that the community was on your side on that violation report. And, as indicated by the final decision, the person the reported the logo didn't provide proof of his/her claims.

Your logo was uploaded to LogoGround on March 23th, 2020:
https://www.logoground.com/logo.php?id=240043

They registered their domain on March 12th, 2021:
https://uk.godaddy.com/whois/results.aspx?checkAvail=1&domain=knivz.co.uk

They only unveiled their logo on Facebook on April 15th, 2021:
https://www.facebook.com/knivzknives/photos/a.100363938864044/100364492197322

Additionally, on their website, it says "Knivz was founded in late 2020":
https://knivz.co.uk/pages/about-us

Therefore, they most definitely don't have a case.

Maybe the admins temporarily hid the logo (not a complete removal), just to wait and see if that person is able to provide undeniable proof; which, obviously, they won't be able to.

Just some thoughts,

Ortega Graphics

Hi ajleroux

I appreciate your understanding. The reported party also gets a chance to respond with declarations of their DMCA counter-notification without any undeniable proof to support their claim.

The web hosting company for knivz[dot]co[dot]uk is Shopify, and the requirements for Shopify’s Merchant to file a counter-notice are generally simple as following:

Please include the following information in your DMCA counter notification:
1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;

2. Your name, address, and telephone number;

3. The following statement: "I consent to the jurisdiction of Federal District Court for the judicial district in which my address is located or, if my address is located outside of the United States, I consent to the jurisdiction of the Federal District Court for the District of Delaware";

4. The following statement: "I will accept service of process from the party who submitted the DMCA Infringement Notice or its agent";

5. The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled and that I am the merchant subject to the DMCA Takedown Notice or I am authorised to act on behalf of that merchant.";

6. The following statement: "I acknowledge that a copy of this counter notification, including my full name and contact information, will be provided to the party that submitted the DMCA Takedown Notice."; and
